Controllers of Personal Information

“Personal Information” refers to any information that identifies or can be used to identify, contact or locate the person, to whom such information pertains including, but not limited to, name, address, phone number, email address, identification number or documents and any other information disclosed by you in relation to the Services. In accordance with Rule 5 of the IT Rules 2011, the Company collects Personal Information and Sensitive Personal Data or Information (“SPDI”) only when it is necessary for providing services, including ERP operations, loan facilitation, onboarding, verification, credit assessment, and regulatory compliance. As per Rule 5(2), information is collected for lawful and necessary purposes, such as, Customer onboarding and identity verification (KYC/AML), Loan origination and facilitation as a Lending Service Provider, Providing ERP and financial workflow services, Credit assessment and underwriting by partner NBFCs, Compliance with RBI regulations, legal and statutory requirements, Fraud prevention and risk monitoring, Customer support and service enhancement Information will not be used for any purpose not connected with the above without obtaining fresh consent. User and Borrower’s consent is provided before sharing personal information with any third party, except for cases where such sharing is required as per statutory & regulatory requirements, law enforcement or any other regulatory agencies. Further borrowers have the right to restrict his /her personal information sharing at any stage. However, withdrawal or restriction may impact continued services. The scope of this statement covers the categories of personal data collected, how we use or process such data, who are the recipients of such data, and your associated rights under applicable laws including how to exercise the same. ARTHUM hereby securitize user for User’s personal data or financial information (including such data as may be designated as ‘personally identifiable data’ under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011). Further ARTHUM adhere and strictly follows the Recommendations of the Working group on Digital Lending – Implementation, dated August 10, 2022 and RBI’s Guidelines on digital lending dated September 02,2022.

EXPRESS WRITTEN CONSENT

The usage of the Website/App may also require you to provide consent for personal Information (including but not limited to user IDs and passwords), as may be necessary to process your application through the Website/App.
Any personal Information which requires to be keyed in/uploaded is required for enabling hassle-free, faster and paperless (to the extent possible) processing of applications for products so opted/ availed by you.
You, whilst providing your details/documents including but not limited to copy of the masked Aadhaar/offline Aadhaar xml (for the purpose of verification), expressly consent to ARTHUM (including its service provider/ business partner) to authenticate/verify such personal Information submitted by you, through the creation of images of such documents including retaining such images for business purposes. What Personal Information About Customers Does www.arthum.co.in Gather?

The Company’s ERP module (“ERP System”) collects and processes various categories of Personal Data and Sensitive Personal Data or Information (“SPDI”), including:

Employee data: name, contact details, address, date of birth, gender, employee ID, department, designation. Sensitive data (as defined under SPDI Rules): Financial information (bank account details for salary processing, UPI details, reimbursement accounts), Biometric data (if used for attendance/verification), Attendance & work-related information: login–logout times, shift details, leaves, attendance logs, GPS-based location (Only for Attendance tracking). Operational data: workflow records, task logs, productivity data, project/location information, communication trails. Document uploads: ID proofs, invoices, compliance documents, contracts, internal approvals.

The ERP System processes personal data strictly for legitimate business purposes, including, Employee lifecycle management (onboarding, HR records, payroll) , Workforce tracking, attendance, leave, and shift management, Salary processing, reimbursements, EPFO, and statutory compliance, Vendor/contractor onboarding, verification, and payments, Workflow approvals, task monitoring, and performance review, Operational reporting, audit records, and quality control

Collection and purpose of Location Data

The Company may collect, access, store, and process location data (“Location Information”) from your device or browser when you use our ERP mobile application. This includes, GPS-based precise geolocation, Network-based or IP-based coarse location, Background location (only if expressly permitted), Geotagging via check-in/check-out features, Location embedded in images or documents uploaded.

We collect location information strictly for legitimate and operational purposes, such as ERP modules operations

Location data is collected only with your explicit consent as required under: IT Act & IT (Reasonable Security Practices & Procedures) Rules, 2011, DPDP Act, 2023.

Security controls include Role-based access control (RBAC), Password-protected access and two-factor authentication, Encryption at rest and in transit, Secure cloud or on-prem infrastructure, Logging and audit trails, Intrusion detection and vulnerability assessments, Regular data backups and business continuity measures. Only authorized personnel with a legitimate need have access to ERP data.

The ERP System does not use personal data for profiling, automated decision-making, or any unrelated purposes.

Processing of personal data within the ERP System is based on Contactor manpower consent, Employee consent, Compliance with contractual obligations, Statutory requirements, and Legitimate business interest for operational efficiency.

Data Sharing & Disclosure- ERP data may be shared only with, Authorized HR, finance, operations, and managerial personnel, Payroll processors, auditors, or compliance partners under confidentiality obligations, Statutory bodies, regulators, or law enforcement agencies where legally mandated.

The Company does not sell, rent, or trade ERP data to third parties.

or Loan facilitation and EWA- We may collect the following categories of information when you use our loan & EWA facilitation services, Personal Information( Name , Phone Number , Email ID, DOB, gender , PAN , Masked Aadhar ( along with explicit consent) , and Sensitive Information ( bank account details ( as per lenders instructions), Income proofs , Repayments, KYC documents, Loan requests data like Credit bureau reports , Loan requests and risk assessment data , Transactions history etc.

We process your data strictly for the following lawful purposes, Loan facilitation services and regulatory compliance ( for lender and ARTHUM), Service delivery and support.

We may share the data with Banks, NBFC and other regulated entities , with any third party provider ( with written explicit consent).

As per RBI guidelines, borrowers are entitled to Know which RE (Bank/NBFC) is processing the loan, Know what data is being shared, Receive disclosures of APR, repayment schedule, and all charges , Access the Key Fact Statement (KFS).

The Company is not responsible for privacy practices of Partner NBFC websites, Third-party payment pages, External portals integrated with the LSP platform. However, all integrations comply with RBI norms.

We implement Reasonable Security Practices including, Encryption (data in transit & at rest), Access control internal policies, Audit logs, Regular security testing, Secure cloud infrastructure.

We receive and store your details and fetch data from the documents you have uploaded while submitting the application for the LENDER’s/ LSP partner Connected with the system. E-mail Communications, each time you login, we verify if it’s you only. An OTP is sent to you on your registered email id.

We do not make credit decisions solely on automated profiling. Credit assessment is performed by the Regulated Entity (RE) based on its internal policies.

The company does not sell data, share data with unauthorised party and allow RE to excess more than necessary.

We do not knowingly collect or process data of individuals below 18 years of age.

We collect and process personal data only with explicit, informed consent.
Users and borrowers of the System have the right to request access to their stored personal data, request correction of inaccurate information, request deletion of data (where legally permissible), Seek clarification on data use and processing, raise objections or concerns with the Grievance Officer, Requests will be addressed within the timelines specified under applicable laws.
By using the ARTHUM System, employees, vendors, and contractors acknowledge that their data will be collected and processed in accordance with this Privacy Policy and applicable law.
We receive and store any information you enter on our website or give us in any other way. We use the information that you provide for such purposes as responding to your requests.
